ViroTek Services LLC. takes all removal service orders through our website or over the phone. Therefore, we are unable to obtain a written and/or signed service agreement. For all intents and purposes regarding financial and/or legal issues, the terms and conditions found here shall constitute a legally binding service agreement and shall have the same force and effect as a signed service agreement. IF YOU DO NOT AGREE WITH THESE TERMS AND OR CONDITIONS, PLEASE DO NOT USE OUR SERVICE(S).

We make every effort possible to ensure timely and reliable pickup of items. However, due to circumstances beyond our control, we cannot and do not guarantee delivery times or dates. Inclement weather, hazardous roads and driving conditions, traffic delays, motor vehicle accidents, delays at facilities, equipment failure, etc., happen occasionally and we cannot be responsible for these delays.
We CANNOT and DO NOT guarantee next day service for deliveries or pickups. It may take up to 48 hours for your items to be picked up, depending on all of the above circumstances and how busy the driver’s schedule is. If you do not agree with these terms, please do not use our service. In these situations, we do not refund or credit any amount of money. Again, if you do not agree with these terms, please do not use our service. By using our services, you hereby acknowledge and agree to these terms and conditions.
If, upon arrival, an item is found to be infested with bugs and not disclosed during the booking, there will be no refund given to the customer.
If, upon arrival at home, additional items are taken or additional services are needed, the additional charge will be applied to the card based on what the current website is advertising.
If it rains, snows, sleet, hail, etc. there can be delays, please understand we have no control over these acts of God. This may affect the timeliness of your service.
ViroTek Services LLC is not able to accept pickup of items because of bedbug or carpet bug infestations. If your item has severe soiling or is waterlogged, contact us at info@virotekservices.com to ensure we are prepared to service your item.
ViroTek Services LLC shall NOT be responsible for ANY DAMAGES to a customer’s home, pavement, curbing or any other driving surfaces resulting from the weight of the truck for service at the customer’s location. ViroTek Services LLC shall not be responsible for any damage to the customer’s property, including but not limited to the home, driveways, walkways, structural damage and landscaping and lawns.

ViroTek Services and its affiliates or subsidiaries reserve the right to dispose of items in the best manner possible.
While we do strive to recycle and donate as many items as possible, we cannot and will not guarantee that items (mattresses and furniture) will be recycled. Certain circumstances can and do prevent us from recycling.
Potential circumstances that would prevent recycling include, but are not limited to, the following:
Lack of recycling/donation facility within proximity to pickup location
Recycling or donation center refusal of items
Poor condition or contamination of items
Bed Bugs or other insect infestation
Bad weather

Due to the fact that we accept payment via credit card through our website and over the phone prior to removal of items and due to a certain level of uncertainty, because fees and or charges can apply after the initial removal service order, you agree and give authorization to ViroTek Services LLC to retain your credit card information for up to 120 days beyond the day of your schedule removal and to charge your credit card for any fees or charges that may apply which are covered in the terms and conditions above.
Pricing through our online site virotekservices.com is for the service of hauling away items. You, as the user, acknowledge and understand that our pricing is subject to change with or without prior written notice before an order is placed. ViroTek Services LLC will not change pricing on a current order placed by a user, assuming the information provided to ViroTek is accurate. The user acknowledges and understands that pricing is up-front and well detailed when placing an order.
Our services are offered to be rescheduled at any point free of charge. If, in any case, a scheduled appointment is rescheduled and cancelled, then the cancellation fee will be applied.
If you choose to cancel an order, you may incur a cancellation fee. In order to cancel an order with our standard 25% cancellation fee, you must cancel by either calling or emailing us 24 hours prior to the start of your requested service window.
If you choose to cancel less than 24 hours prior to the start of your service window, you will be charged a 50% cancellation fee.
ELECTRONIC COMMUNICATIONS
When you send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We may choose to communicate with you by e-mail or text messaging. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
INTELLECTUAL PROPERTY
Trademarks. The trademarks, trade dress, logos, and service marks (collectively the "Trademarks") displayed on the Sites are registered and unregistered Trademarks of ViroTek, its affiliates, its third-party licensors and others. You are not permitted to use any of the Trademarks displayed on the Sites without the prior, express written consent of ViroTek, its affiliates, or the third-party licensors that may own the Trademark. You may not use any hyper or HTML links, meta tags or any other "hidden text" utilizing ViroTek or its affiliates’ name or Trademarks without the express written consent of ViroTek, its affiliates, or third-party licensors. All rights reserved.
Sites Materials. All Trademarks, and materials displayed on, or contained within the Sites, including, but not limited to, layout, color schemes, design, text, editorial materials, informational text, photographs, illustrations, artwork and other graphic or digital materials, and names (collectively, the "Materials"), are the property of ViroTek, its affiliates or its licensors and are protected by copyright, trademark, patent and all other applicable intellectual property laws. You acknowledge and agree that the Sites and the Materials are the property of ViroTek, its affiliates and licensors, and that you will not acquire any rights or licenses in any trademarks, patents, copyrights, or other intellectual property on the Sites or in the Materials. You may download a copy of the Materials for your personal non-commercial use. You may not frame or utilize framing techniques to enclose any materials or trademark or other proprietary information (including images, text, page layout, or form) of ViroTek or its affiliates without the express written consent of ViroTek.
Any copies that you make of the materials must retain all our copyright and other notices. Except as expressly provided for in these Terms of Use, you may not (i) reproduce, modify, publish, transmit, display, perform, distribute, disseminate, broadcast, circulate, or otherwise exploit any content on the Sites, including, but not limited to, any Materials, in whole or in part, to any third party; (ii) participate in the transfer, license or sale of any content on the Sites, including, but not limited to, the Materials; or (iii) create derivative works or in any way exploit any content on the Sites, including, but not limited to, the Materials. No portion of the content on the sites may be stored on a computer except for personal and non-commercial use. All rights not expressly granted herein are reserved.
PERMISSIBLE USE

If you are under the age of majority, you may use the sites only with permission and the involvement of a parent or guardian. ViroTek Services LLC and its affiliates reserve the right to refuse service, terminate accounts, or remove or edit content at our sole discretion.

INDEMNIFICATION

You agree to indemnify, defend and hold ViroTek Services LLC and its affiliates, and their respective officers, directors, owners, employees, agents, information providers and licensors (collectively the "Indemnified Parties," or individually, “Indemnified Party”) harmless from and against any and all claims, liability, losses, actions, suits, costs and expenses (including attorneys’ fees) arising out of or incurred by any breach by you of these Terms of Use. ViroTek Services LLC reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with ViroTek Services LLC in defense of such claim. ViroTek Services LLC and its affiliates have no duty to reimburse, defend, indemnify, or hold you harmless resulting from, relating to, or arising out of, these Terms of Use or the Sites.

RELEASE
All users of our Sites acknowledge and agree that each Indemnified Party is released, discharged, and held harmless from any and all liability from third-party claims made in connection with the Sites, including, without limitation, wrongful death and personal injury, money damages, out-of-pocket and court costs, attorney’s fees, damage to tangible property or reputation, including, without limitation, libel, defamation, right of publicity and invasion of privacy. ViroTek reserves its right to all forms of equitable and legal relief related to fraud or illegal activity connected to the use of our sites.

MISCELLANEOUS
